PRESENTATION: As providers working in the addictions and allied professions, clinicians and others are required to adhere to ethical and legal mandates in order to do no harm while delivering evidence-based, client-centered treatment and recovery support.  NAADAC's Code of Ethics (revised 01.01.21) provides the profession with standards of practice and boundaries of practice.  We will integrate day-to-day confidentiality, privacy, and ethical concerns that come up.  This 6-hour workshop on advanced ethical practices will build on ethical and confidentiality requirements at the state and federal levels, lessons from our telehealth/Covid experiences, hybrid practices, and business concerns.  There will be in-depth discussions, using case studies, on the following topics: 

  • confidentiality:  HIPAA, 42 CFR Part 2, PDMP
  • privacy: privileged communications; subpoenas; court orders
  • alignment:  standards of practice versus scope of practice
  • staying in your lane:  clinical supervision and professional development
  • informed consent:  legal, trauma-specific, and technology-specific
  • embracing a culturally diverse practice: diversity, equity and inclusion; CLAS standards; CFI
  • boundaries:  crossings versus violations; dual relationships; counseling across borders
  • the person of the counselor:  impairment versus functionality; self-care at work
  • credentials:  risk management; consultation; documentation
  • The virtual workshop will be very interactive, allowing for open dialogue with attendees about real life scenarios and concerns for all of us to consider.  Please bring your questions, concerns and comments.

    At the end of this training, participants will be able to:

    • Discuss how to adhere to ethical and legal mandates in order to do no harm while delivering treatment and recovery support services
    • Understand the ethical and confidentiality requirements at state and federal levels.
    • Be able to explain ethical issues and lessons encountered during the COVID-19 pandemic including telehealth, hybrid practices, and business concerns.

    ABOUT THE PRESENTER: Mita M Johnson, EdD, LPC, LMFT, LAC, MAC, SAP has been practicing in the world of mental health, marriage and family, and addictions counseling for the past 30 years. She earned her Doctorate in counselor education and supervision, and is a core faculty member in the School of Counseling program at Walden University. In addition, she has a thriving private practice where she provides telebehavioral health services, clinical supervision, counseling to our military, and addiction-specific training and education. Dr. Johnson served as NAADAC's President, Regional Vice President, Treasurer and Ethics Chair, and began her 2 year term as NAADAC’s Immediate Past-President in October 2022.
